Overview

This website is operated by All Kinds of Watches. Throughout these Terms, the words “we”, “us” and “our” refer to All Kinds of Watches.

These Terms of Service (“Terms”) apply to your use of our website and to purchases made from us through the website. By using our website or placing an order, you agree to these Terms together with our Privacy Policy, Return and Refund Policy and Shipping Policy.

Our online store is hosted by Shopify, which provides the ecommerce platform that enables us to offer our products for sale.

Nothing in these Terms affects your statutory rights as a consumer.

1. About Us

All Kinds of Watches is an independent UK watch seller operated by Ricardo Marques as a sole trader.

We sell watches including new and pre-owned watches, vintage and modern watches, mechanical and quartz watches, digital watches, pocket watches and watches sold as projects, non-working, spares or repair.

2. Using Our Website

You may use our website only for lawful purposes.

You must not misuse the website, interfere with its operation or security, introduce malicious software, attempt unauthorised access, use the website fraudulently, or use our content in a way that infringes our or another person's intellectual property rights.

We may suspend or restrict access to the website where reasonably necessary for security, maintenance, suspected misuse or other legitimate business reasons.

3. Our Watches

We make reasonable efforts to describe and photograph every watch accurately.

Many of our watches are vintage or pre-owned. They may therefore show signs of age, wear, previous use, repair or replacement of components. These characteristics will vary from watch to watch.

Please read the individual product description and examine the photographs before purchasing.

The photographs form an important part of the description of pre-owned and vintage watches. Colours and appearance may vary slightly depending on your screen or device.

Unless expressly stated otherwise in the individual listing, no representation is made that a vintage or pre-owned watch has recently been serviced or that its accuracy, water resistance or performance meets the standards of a new watch.

Any specific information about condition, operation, accuracy, water resistance, service history, movement, components or other characteristics will be stated in the individual product listing where known and relevant.

Nothing in this section affects your statutory rights, including your rights where goods are faulty or not as described.

4. Non-Working, Project and Repair Watches

Some watches may be offered specifically as non-working, spares or repair, project watches, or with particular faults clearly disclosed in the product description.

Where a particular fault or condition is clearly disclosed before purchase, that disclosed condition forms part of the description of the item and should be taken into account when deciding whether to purchase it.

A watch described as non-working or requiring repair should not be assumed to become fully operational following any particular repair unless expressly stated in the listing.

This does not exclude or restrict your statutory rights if the item is otherwise not as described or if you have rights that cannot legally be excluded.

5. Prices

Prices displayed on our website are in pounds sterling (GBP) unless stated otherwise.

The price payable is the price displayed when you place your order, subject to correction of obvious pricing or listing errors.

Delivery charges are shown separately where applicable before you complete your purchase.

We may change prices at any time, but a price change will not affect an order that we have already accepted.

We are not currently VAT registered, so our prices do not include a separately charged amount of VAT.

6. Orders and Formation of the Contract

When you submit an order, you are making an offer to purchase the item.

Receiving an automated order acknowledgement does not necessarily mean that we have accepted your order.

We may decline or cancel an order before acceptance where there is a legitimate reason to do so, including where an item is unavailable, there has been an obvious pricing or listing error, payment cannot be authorised, we reasonably suspect fraud, or we cannot deliver to the address provided.

If we cancel an order after taking payment, we will refund the amount due to the original payment method.

Once your order has been accepted, a contract exists between you and All Kinds of Watches.

7. Payment

Payment must be made using one of the payment methods offered at checkout.

Payments may be processed by Shopify Payments, PayPal or another payment provider displayed at checkout.

You must provide accurate billing and payment information and must be authorised to use the payment method you provide.

We do not normally receive or store your complete payment-card details when payments are processed by our payment providers.

8. Delivery

Our available delivery methods, prices and estimated delivery times are shown at checkout and/or in our Shipping Policy.

Delivery times are estimates unless we expressly agree otherwise.

We will deliver goods within the period required by applicable law. UK distance-selling guidance provides that goods should normally be delivered within 30 days unless another delivery period has been agreed.

We are not responsible for delays caused by circumstances genuinely outside our reasonable control, although this does not affect any rights or remedies you have under applicable consumer law.

Where we arrange delivery, the goods remain at our risk until they come into your physical possession or the physical possession of a person you identify to receive them.

Different rules may apply if you independently arrange a carrier that we did not offer.

9. Cancellation and Change-of-Mind Returns

If you are a consumer purchasing online, you normally have the right to cancel your purchase without giving a reason within 14 days after receiving the goods.

To exercise this right, you must clearly inform us of your decision to cancel within the applicable cancellation period.

After notifying us, you must return the goods within the period required by law.

For change-of-mind returns, you are responsible for the direct cost of returning the goods where we have informed you of this obligation.

UK distance-selling rules generally provide a 14-day cancellation period after delivery and a further 14 days for returning goods after cancellation has been notified.

10. Handling Returned Watches

You may inspect a watch to the extent reasonably necessary to establish its nature, characteristics and functioning, in broadly the same way that you could inspect it in a shop.

If you handle an item beyond what is reasonably necessary and this diminishes its value, we may make an appropriate deduction from the refund where permitted by law.

Please return all items originally supplied with the watch, such as boxes, papers, spare links, straps and accessories where applicable.

11. Refunds Following Cancellation

Where you validly exercise a statutory cancellation right, we will refund payments due in accordance with applicable consumer law.

This includes the original standard delivery charge where required by law. If you selected a more expensive delivery service, we are not required to refund the additional amount above the cost of our standard delivery service.

Refunds will normally be made using the same payment method used for the original purchase unless otherwise agreed.

12. Faulty or Incorrectly Described Goods

Your statutory rights are separate from your change-of-mind cancellation rights.

If a watch is faulty, not as described or otherwise fails to meet requirements imposed by applicable consumer law, you may be entitled to a remedy.

Please contact us at contact@allkindsofwatches.co.uk if you believe there is a problem with an item.

A fault or condition that was clearly disclosed before purchase — for example, a watch expressly sold as non-working — will be taken into account when determining whether the item corresponds with its description.

Nothing in these Terms excludes or restricts your statutory rights. UK government guidance confirms that traders cannot remove or mislead consumers about their statutory refund rights for faulty or incorrectly described goods.

13. Availability and Listing Errors

Because many of our watches are individual or one-off items, availability can change quickly.

Occasionally our website may contain an incorrect price, description, photograph, availability status or other error.

We may correct errors or update information when discovered.

If an error materially affects an order you have already placed, we will contact you. Where we cannot fulfil the order as agreed, we may cancel it and refund any payment received.

Nothing in this section allows us to alter a concluded consumer contract where doing so would be contrary to applicable law.

14. Intellectual Property

Unless otherwise stated, the content we create for this website, including our original photographs, written descriptions, branding, graphics and website content, belongs to All Kinds of Watches or is used with permission.

You may view the website for personal use.

You may not reproduce, commercially exploit, systematically copy or republish our original content without permission except where permitted by law.

Third-party trademarks, watch brand names and logos remain the property of their respective owners. Reference to a watch manufacturer or brand does not imply that All Kinds of Watches is authorised, sponsored or endorsed by that manufacturer unless we expressly state otherwise.

15. Third-Party Services and Links

Our website may use or link to services provided by third parties, including payment providers, delivery providers and other websites.

Those third parties may operate under their own terms and privacy policies.

We are not responsible for the content or operation of independent third-party websites merely because our website links to them.

Nothing in this section excludes responsibility that we cannot legally exclude.

16. Shopify

Our store is powered by Shopify, which provides the ecommerce technology used to operate the online store.

Purchases made from our store are contracts between you and All Kinds of Watches, not between you and Shopify.

Shopify may process information relating to your use of the store as described in the applicable privacy information.

17. Privacy

We process personal information in accordance with our Privacy Policy.

Our website and ecommerce services are hosted using Shopify, and certain information may therefore also be processed by Shopify and other service providers necessary to operate the store, process payments and fulfil orders.

18. Reviews and Feedback

If you submit a review, comment or other feedback to us, you confirm that you have the right to submit it and that it does not infringe another person's rights or contain unlawful, defamatory, abusive or misleading material.

You grant us permission to display and use feedback you voluntarily submit in connection with our business and website.

We may moderate or remove content where reasonably necessary, including content that is unlawful, fraudulent, abusive, irrelevant or infringes another person's rights.

19. Website Availability

We aim to keep our website available and accurate, but we cannot guarantee that it will always operate without interruption or technical errors.

We may temporarily suspend, change or withdraw parts of the website for maintenance, security, technical or operational reasons.

This does not affect any contract already formed with you or any statutory rights you have concerning a purchase.

20. Liability

Nothing in these Terms excludes or limits liability where it would be unlawful to do so.

In particular, nothing in these Terms excludes or restricts your statutory rights as a consumer or any liability that cannot legally be excluded or restricted.

To the extent permitted by law, we are not responsible for losses that were not reasonably foreseeable when the contract was formed or losses resulting from circumstances outside our reasonable control.

If you are purchasing as a consumer, we do not exclude liability that applicable consumer law requires us to bear.

21. Events Outside Our Reasonable Control

We will not be responsible for a failure or delay in performing an obligation where it results from circumstances genuinely outside our reasonable control.

If such circumstances materially affect an order, we will take reasonable steps to minimise the effect and will contact you where appropriate.

Your statutory rights remain unaffected.

22. Changes to These Terms

We may update these Terms from time to time, for example to reflect changes to our business, website, services or applicable law.

The Terms applicable to your purchase will normally be those in force when the relevant contract was formed, except where a change is required by law or otherwise lawfully agreed.

The current version will be published on our website.

23. Severability

If any provision of these Terms is found to be unlawful, invalid or unenforceable, that provision will be treated as modified or removed to the minimum extent necessary.

The remaining provisions will continue in effect.

24. Governing Law

These Terms and contracts between you and All Kinds of Watches are governed by the laws of England and Wales.

If you are a consumer resident elsewhere in the United Kingdom, you may also benefit from mandatory consumer protections and rights relating to the courts available to you under the law applicable to you.

Nothing in these Terms deprives you of mandatory consumer rights that apply to you.
